Zero Waste Alliance Ireland welcomed the opportunity to submit observations on the proposed regulation of costs in certain environmental legal proceedings. We firmly contend that the proposed cost limits would significantly undermine access to justice, create a pronounced inequality of arms and have a chilling effect on public-interest environmental litigation. ZWAI maintains that the proposals are incompatible with the Aarhus Convention and EU law, and therefore calls for their immediate withdrawal to safeguard environmental democracy and the public’s right to challenge unlawful decision making.
